General Terms and Conditions

1. GENERAL PROVISIONS
1.1. These General Terms and Conditions (hereinafter referred to as “Terms”) apply to all services provided by ABSOLUT (hereinafter referred to as “Agency”) in the scope of activities including:
– Rental and leasing of watercraft (NKD 77.34)
– Maritime and coastal passenger transport (NKD 50.10)

2. RESERVATIONS AND PAYMENT
2.1. Reservations can be made via email, phone, in person or online (if available). A reservation becomes valid upon confirmation from the Agency and the payment of the agreed deposit.

2.2. The remaining rental fee and/or transportation service charge must be paid no later than on the day of vessel pickup or the start of the service.

2.3. The Agency reserves the right to cancel the reservation in case of force majeure, adverse weather conditions, or technical malfunction of the vessel, with a full refund of the paid amount.

2.4 Payment by Credit Card (CorvusPay gateway)

Customers can easily make reservations through our booking engine and complete their payment securely using a credit card. All transactions are processed by CorvusPay, a trusted and reliable payment gateway. We accept a wide range of credit cards, ensuring a smooth and convenient payment experience for our guests.

Payment via bank transfer

Customer will receive Agency bank account information by e-mail and will have two working days to make the payment and to send us payment confirmation. Upon receiving the payment, Agency will send to Customer the confirmation (Voucher) and all the details regarding the tour via e-mail. For reservations exceeding the total amount of EUR 2500, 50% prepayment by bank transfer is required at the time of the booking. The remaining balance of the total amount has to be paid at least seven days before the date of the trip in one of the Agency offices or by Bank transfer.

We ask that all international transfers to us be made with the OUR instruction, which means that all bank charges are to be paid by Customer.

Online payment by link

Customer will receive a payment link from our team. All payment links will be valid for 4 days and in that period client is obligated to finish reservation. After payment is done our team will send voucher to client and with that reservation is confirmed

2.a CREDIT CARD PAYMENT SECURITY

CorvusPay system ensures complete privacy of your credit card data and personal data from the moment you type them into the CorvusPay payment form. Data required for billing is forwarded encrypted from your web browser to the bank that issued your payment card. Our store never comes into contact with your sensitive payment card data. Similarly, CorvusPay operators cannot access your complete cardholder data. 💳 MasterCard® SecureCode™ is a new service from MasterCard and your card issuer that provides additional protection when shopping online.
You don’t need a new MasterCard or Maestro® card to use this service. You create your personal MasterCard SecureCode, which you never share with any online retailer. This private code adds an extra layer of security against unauthorized use of your credit or debit card while shopping online.

Every time you make an online payment with your MasterCard or Maestro card, a window will appear from your card issuer asking you to enter your personal SecureCode, similar to entering a PIN at an ATM. Within seconds, your issuer confirms your identity and your purchase is safely completed.

Verified by Visa is a new service that allows you to shop online with extra security.

2.b DISCLAIMER OF DIFFERENCE CAUSED BY EXCHANGE RATE

(For clients who make payment by credit card only).

Agency will draw Euro (EUR) from your credit card. The Credit Card Company or Bank will convert this amount to the currency of your credit card account. Please mind that prices stated on our websites in EUR are only approximate and used for Customer’s easier understanding. As a result of this conversion, there is a possibility of a slight difference from the original price stated on our website.

3. Cancellation, Reservation modification and Refund Policy

3.1. In the event of cancellation, the following fees will apply:
– Cancellations made 7 days or more prior to departure: No charge.
– Cancellations made between 5 to 7 days prior to departure: 30% of the total trip cost.
– Cancellations made less than 2 days prior to departure: 50% of the total trip cost.
– No-shows will incur the total price of the reservation.

3.2. Refunds will be processed within 14 days of receiving your written cancellation request, minus any applicable cancellation fees.

4. VESSEL RENTAL TERMS
4.1. The renter must possess a valid license to operate the vessel if the vessel is rented without a skipper.

4.2. Vessels are rented in proper and clean condition, with a full fuel tank and appropriate safety equipment. The renter is obliged to return the vessel in the same condition.

4.3. The renter is responsible for any damage incurred during the rental period, unless caused by a technical malfunction not resulting from improper handling.

4.4. It is prohibited to transfer the vessel to third parties without prior consent from the Agency.

5. PASSENGER TRANSPORT SERVICES
5.1. Maritime and coastal passenger transport services are conducted according to pre-agreed routes and schedules.

5.2. The Agency reserves the right to change the route or departure time for safety reasons, adverse weather conditions, or technical issues.

5.3. Passengers must comply with crew instructions and adhere to maritime safety rules.

6. LIABILITY
6.1. The Agency is not liable for damages or injuries resulting from non-compliance with instructions, improper use of the vessel or unforeseen weather conditions.

6.2. Passengers and renters are responsible for securing their personal belongings and documents. The Agency is not liable for theft, loss or damage.

7. COMPLAINTS AND DISPUTE RESOLUTION
7.1. Complaints regarding services can be submitted in writing to the Agency’s address or via email. The Agency commits to responding to complaints within 15 days.

7.2. In the event of a dispute, both parties will attempt to resolve the issue amicably. If this is not possible, the competent court at the Agency’s headquarters will have jurisdiction.

8. PERSONAL DATA PROTECTION
8.1. The Agency collects and processes personal data of users solely for the purpose of service execution, in accordance with applicable data protection laws and the EU General Data Protection Regulation (GDPR).

8.2. Data will not be shared with third parties without the explicit consent of the user, unless legally required.

9. FINAL PROVISIONS
9.1. These Terms are effective from the date of publication on the official website or from the date of the service agreement with the user.

9.2. The Agency reserves the right to amend these Terms at any time, with prior notice given to the customers.
